Terms of Service

Agreement

These Terms of Service ("Terms") govern your access to and use of Sun AI Music, including its website, accounts, AI music and audio tools, Credits, Subscriptions, private Library, and downloads. "We," "us," and "our" refer to the site and its operator.

By using the service, you agree to these Terms and our Privacy Policy. If you use the service for an organization, you confirm that you have authority to accept these Terms for that organization.

The Service

Sun AI Music provides the music generation, conversion, analysis, playback, and download features that are identified as available in the product. A page describing a possible or future tool does not guarantee that the tool is available.

AI and audio results are generated by automated systems and may be inaccurate, unexpected, similar to other material, unavailable, or unsuitable for your intended use. We may change, suspend, or discontinue a feature, model, Credit cost, or usage limit, subject to any access already owed under an active paid period.

Accounts

Google Continue is the current account-access method. You are responsible for the security of your Google account and for activity performed through your Sun AI Music Session. You must provide accurate information and promptly contact us if you believe your account has been compromised.

You may not sell, transfer, or share account access, evade a suspension, or use automation to circumvent Credits, rate limits, or other service controls.

Your Inputs

You retain the rights you hold in prompts, original lyrics, audio, images, voices, and other material you submit ("Inputs"). You grant us and our service providers a limited, worldwide license to host, copy, transmit, process, adapt, and display Inputs only as needed to operate and secure the requested service, provide support, and meet legal obligations.

You confirm that you have the permissions needed to submit each Input. Do not submit copyrighted works, personal data, recordings, names, likenesses, or voices in a way that violates another person's rights.

Generated Results and Commercial Use

As between you and us, we do not claim ownership of the music result generated for your private account (a "Result"). Rights in AI-generated material vary by jurisdiction, and these Terms do not guarantee that a Result qualifies for copyright or another exclusive right.

The plan and entitlement shown for a Result determine its permitted use:

• Free welcome usage and Starter Results are for personal, non-commercial use.
• Qualifying Creator Results may be downloaded as original MP3 files and used in commercial projects.
• Qualifying Studio Results may also use the available WAV export and be used in commercial projects.

Commercial use may include monetized content, client work, advertising, games, podcasts, and music distribution, provided that your Inputs and use comply with these Terms and applicable law. Commercial permission does not guarantee that a Result is unique, copyright-registerable, accepted by a distributor, or free of third-party claims. You are responsible for reviewing a Result before publishing or relying on it.

Credits and Generation Jobs

Credits are a service usage unit, not money, stored value, or property. The service displays the applicable Credit cost before a supported action is submitted. Credits may be promotional, expire, refresh with a plan, or be subject to limits shown when they are granted.

An accepted Generation Job may take time to complete. When a terminal provider failure produces no playable result, the current standard song workflow restores the Credits charged for that Job. A disliked, unexpected, or commercially unsuitable Result is not a failed Job and does not itself create a refund or Credit entitlement.

Subscriptions and Payment

Paid plans are billed in advance through Waffo Pancake at the price and cadence shown during Checkout. Subscriptions renew until canceled. A cancellation normally takes effect at the end of the current paid period; it does not erase Results already retained in the account.

You can change Plans through Billing. Available changes, any payment due, and the effective date are shown before you confirm a change. When a change takes effect, unused Credits from the old Subscription are removed and the new Plan's full monthly allowance is issued. Credits already used are not deducted again. Yearly Plans continue to release Credits monthly. Welcome Credits and Credits from a redeemed code keep their own balance and expiry. A change scheduled for the end of the paid period leaves the current Plan and its benefits in place until it takes effect.

Plan benefits, Credits, download formats, and commercial-use permissions apply only as displayed for the relevant plan and Result. You may not pay once, reverse or dispute the payment without a valid basis, and continue using paid benefits.

Support may approve a full refund of the first Subscription payment when the request is made within three days and no successful Generation Job has consumed Credits from that payment. Refunds outside that rule are not promised except where required by law. A refund or payment dispute may revoke or freeze unused Credits and future plan benefits while it is reviewed.

Acceptable Use

You may not use the service to:

• violate law or another person's intellectual-property, privacy, publicity, contractual, or other rights;
• impersonate a person or use a voice, identity, or likeness without the required permission;
• create or distribute fraud, malware, harassment, exploitation, or other harmful or illegal material;
• probe, disrupt, overload, reverse engineer, scrape, or gain unauthorized access to the service or its providers;
• bypass Credits, access controls, download entitlements, or technical protections; or
• resell the service itself or falsely present a Result as guaranteed to be human-made, unique, or legally cleared.

AI Content Standards and Prohibited Categories

You must not ask the service to generate, and must not use, store, publish, or distribute a Result as, any of the following:

• sexual, pornographic, or other NSFW content;
• graphic violence, gore, or content that celebrates or encourages real-world violence;
• hate speech or content that attacks, dehumanizes, or promotes discrimination against people based on a protected characteristic;
• child sexual abuse material (CSAM), sexualized content involving a minor, or any other content that exploits or endangers children;
• a deceptive deepfake or impersonation of a real person, including use of a person's name, identity, likeness, or voice without the required permission; or
• content that infringes or misuses another person's copyright, trademark, or other intellectual-property rights.

CSAM and other content that sexually exploits or endangers children are strictly prohibited. We may preserve relevant evidence and report suspected illegal material to the appropriate authorities when required or permitted by law.

Content Moderation, Reports, and Enforcement

Generated Tracks are kept in private account Libraries by default; the service does not operate a public feed of user-generated music. Our current moderation process is risk- and report-driven. When we receive a report or otherwise have reason to believe these Terms were violated, we manually review the report and the account, Generation Job, Input, Result, and technical records reasonably needed to decide what happened. We do not represent that every Input or Result is reviewed before it is processed or delivered.

Report suspected prohibited content, impersonation, child-safety concerns, or copyright or trademark infringement through our contact form or by emailing support@sunaimusic.com. Include the relevant Job or Track details, a description of the concern, and any information that helps us locate and assess the material. Do not attach or forward suspected CSAM; instead, identify where it appeared and provide only the information needed to locate it safely.

Depending on the nature, severity, and recurrence of a violation, we may reject or stop a Generation Job, remove or disable access to a Result, warn the User, restrict features, suspend or terminate an account, preserve evidence, or notify the appropriate service provider or authority. We may act immediately when needed to protect a child, another person, the service, or the integrity of an investigation.

Suspension and Termination

You may stop using the service and cancel an active Subscription through the available billing controls. We may restrict or terminate access when you violate these Terms, create security or payment risk, misuse a third-party service, or when restriction is required by law.

Termination ends future access but does not remove payment, dispute, security, or legal records that we must retain. You should download any Result you are entitled to keep before closing an account or losing the applicable download access.

Third-Party Services

The current music-generation workflow uses Kie.ai's Suno music generation API with its Suno V5.5 model option (API identifier V5_5). Google, Waffo Pancake, Cloudflare, Kie.ai, Suno, and other linked or integrated services have their own terms and privacy practices. We are not responsible for a third-party service outside the part we control.

Disclaimers

The service is provided "as is" and "as available." To the extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free service. We do not warrant a particular creative, technical, legal, or commercial outcome from an AI or audio tool.

Limitation of Liability

To the extent permitted by law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunity arising from the service. Nothing in these Terms excludes liability that cannot legally be excluded.

Changes to These Terms

We may update these Terms as the service or applicable requirements change. The date above identifies the current published version. Continued use after an updated version takes effect means you accept the updated Terms.
